These Terms of Service ("Terms") govern your use of LettingDesk ("the Service"), operated by [Company Name] ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
LettingDesk is a property management and accounting platform that enables landlords, letting agents, accountants, and tenants to collaborate on property portfolios. Access to features depends on your account role and subscription status.
2. Account registration
- You must provide a valid email address and maintain accurate account information.
- You are responsible for all activity under your account and must keep your credentials secure.
- Accounts are for individual use. Each person must register with their own email address.
- You must be at least 18 years old to use the Service.
3. Subscriptions and billing
- Some features require a paid subscription. Pricing is displayed at the point of purchase.
- Free trials are available as stated on our pricing page. No payment is required during the trial period.
- Subscriptions renew automatically. You may cancel at any time through the billing settings in your account. Cancellation takes effect at the end of the current billing period.
- Payments are processed by Stripe. We do not store payment card details.
- Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge if you believe an error has occurred.
- Letting agents who sponsor owner portfolios ("sponsored seats") are billed per active sponsored seat and are responsible for the associated charges.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable law.
- Upload content that is fraudulent, misleading, defamatory, or infringes third-party rights.
- Attempt to gain unauthorised access to any part of the Service or another user's account.
- Reverse-engineer, scrape, or otherwise extract data from the Service by automated means.
- Use the Service to store or transmit malicious code.
We reserve the right to suspend or terminate accounts that breach these rules.
5. Your content
You retain ownership of the data and documents you upload to LettingDesk. By uploading content, you grant us a limited licence to store and process it solely to provide the Service. We do not claim ownership of your content and will not share it except as described in our Privacy Policy.
6. Service availability
We aim to keep LettingDesk available at all times but do not guarantee uninterrupted access. We may perform maintenance, introduce changes, or suspend access temporarily without notice. We are not liable for losses caused by service unavailability.
7. Limitation of liability
To the maximum extent permitted by law:
- LettingDesk is provided "as is" without warranties of any kind.
- We are not liable for indirect, incidental, or consequential losses arising from your use of the Service, including loss of data, revenue, or profits.
- Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months prior to the claim.
Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
8. Termination
You may close your account at any time from your account settings. We may terminate or suspend your account if you breach these Terms, with or without notice depending on the severity of the breach.
On termination, your access to the Service ceases. We will retain and then delete your data in accordance with our Privacy Policy.
9. Changes to these Terms
We may update these Terms from time to time. We will give you at least 14 days' notice of material changes by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
